1. Who we are

CBAM Exporter Pack ("the service") is provided by Hari Krishnan, a sole proprietor trading as Vedacta, Bengaluru, Karnataka 560048, India ("we", "us"). By using the service or creating an account you ("the customer") agree to these terms. The service is made for businesses: you use it for your trade or business (exporting, buying or advising on CBAM goods), not as a consumer. If you use the service for a company, you confirm you may bind that company.

2. What the service does

The service helps you prepare CBAM emissions data from your own records: it reads documents you upload, applies EU calculation methods and produces reports, draft monitoring plans and evidence packs. It does not verify emissions, file declarations or act as your adviser. Read the disclaimer, which forms part of these terms. The paid service is offered only to companies whose verification we approve, and not to companies established in countries our payment provider does not accept payments from (currently Russia, Belarus, Ukraine and Moldova). The free tools and guides are open to everyone. The paid part of the service, the CBAM Evidence Pack (“the pack”), is a one-time purchase per installation and reporting year; CBAM Exporter Pack is the name of the site and its free tools.

3. Your responsibilities

  • You are responsible for the accuracy and completeness of the records you upload and the values you accept.
  • You must have an accredited verifier check any figures before they are given to an EU declarant as actual data.
  • You must only upload documents you are entitled to share, and must not upload unlawful or malicious files.
  • You must keep your login details confidential and tell us promptly of any unauthorised use.

4. Fees and payment

Prices are shown in the app or agreed in writing before purchase. The paid pack is a one-time fee for one installation and one reporting year, payable in advance. Payments are processed by Dodo Payments, which sells the pack to you as merchant of record and handles taxes and receipts. While the paid app is in beta, we refund the pack on request within 14 days of purchase as long as none of its files (report, monitoring plan or evidence pack) has been downloaded. Downloads are recorded with their date, time and network address. Whether or not files were downloaded, if a paid feature fails for a reason within our control and we cannot fix it within 14 days, we will refund the fee for that feature on request.

5. Your data

You keep all rights in the documents and data you upload. You allow us to store and process them only to provide the service, as described in our privacy policy. You can export your outputs and ask us to delete your account and files at any time.

6. Free tools and site content

The free tools and guides need no account and are provided as they are. What you type into the calculators and document tools stays in your browser; the feature and language request forms send what you type to us by email, as the privacy policy describes. The documents they produce (letters, summaries, plans, workbooks, checklists, calculations) are yours to use, change and send as you wish; each one carries a short line saying it was made with these free tools, which you may remove. The site's own text, design and code belong to Hari Krishnan; you may quote and link to it with a reference to the site, but not copy it wholesale. EU legislation and data shown on the site remain © European Union and are reused under Commission Decision 2011/833/EU and, where the Commission applies it, the Creative Commons Attribution 4.0 licence (Commission Decision C(2019) 1655); UK material is Crown copyright, reused under the Open Government Licence v3.0. This site is not affiliated with the EU or the UK government. The data feed at /cbam-data-feed is licensed as stated on that page.

Ads, links and names of other companies' products and services (for example Microsoft Excel and Word, WhatsApp, Google, Cloudflare, Buy Me a Coffee and Dodo Payments) are shown for your convenience; their names are trademarks of their owners, and we do not endorse them or answer for their content.

7. Availability and changes

We aim to keep the service available but do not guarantee uninterrupted operation. EU CBAM rules change; we update default values and methods when official texts change but cannot guarantee that every change is reflected immediately. We may change these terms by posting a new version and, for material changes, emailing account holders at least 14 days in advance.

8. Use at your own risk

The calculators, default values, templates, guides and outputs are estimates and drafts to help you prepare. They are not verified figures and not legal, tax, customs or financial advice. You decide whether and how to use them, check them against the official EU texts and with your accredited verifier and advisers, and you are solely responsible for the decisions you take with them: prices you quote or accept, contracts you sign, figures you send to buyers or declarants, and anything you file.

Any loss of revenue, profit, business, contracts or customers, any price reduction, CBAM certificate cost, penalty, verification cost or other financial loss that results from your use of, or reliance on, the service is yours to bear, not ours, except where section 9 says otherwise.

9. Limitation of liability

To the extent permitted by law, the service is provided "as is" and "as available", without any warranty that it is accurate, complete, up to date or fit for a particular purpose. We are not liable for any indirect or consequential loss, or for the losses described in section 8. For the free tools and guides, which you use without paying, we accept no liability. For the paid service, our total liability for all claims relating to it in any 12-month period is limited to the fees you paid us in that period.

Nothing in these terms excludes or limits liability for fraud, for wilful misconduct or gross negligence, for death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under the law that applies, including the rights of anyone who is a consumer under the Consumer Protection Act, 2019.

10. Claims by others

If a third party (for example your EU buyer, a declarant or an authority) makes a claim against us because of figures or documents you produced with the service and gave to them, or because of how you used the service, you will compensate us for the reasonable cost of that claim, unless it arises from our own breach of these terms.

11. Suspension and termination

You may stop using the service at any time. We may suspend or close an account that breaches these terms or puts the service or other users at risk, with notice where reasonably possible. Sections 3, 5, 6, 8, 9 and 10 survive termination.

12. Law and disputes

These terms are governed by the laws of India. The courts at Bengaluru, Karnataka have exclusive jurisdiction, subject to any rights a consumer has under the Consumer Protection Act, 2019. Please contact us at contact@vedacta.com first; we will try to resolve any complaint within 30 days.
